1. Scope. These Conditions of Sale (“Conditions”) apply to all purchases of products made through www.tisasarmsusa.com (the “Website”) operated by Tisas Arms Corp, d/b/a Tisas USA (“Company”). The Website sells firearms parts, components, accessories, and related merchandise (“Products”). The Website does not sell serialized firearms, frames, or receivers. All sales are subject to these Conditions, our Terms of Use, our Privacy Policy, and our Return and Refund Policy.
2. Eligibility. By placing an order through the Website, you represent and warrant that: (a) you are at least eighteen (18) years of age; (b) you are a resident of the United States; (c) you are legally permitted to purchase, possess, and use the Products in your jurisdiction; and (d) you are not prohibited from purchasing or possessing firearms, firearms parts, or accessories under any applicable federal, state, or local law.
3. Order Acceptance. Your submission of an order through the Website constitutes an offer to purchase the Products identified in your order, subject to these Conditions. All orders are subject to acceptance by Company. We reserve the right to refuse or cancel any order for any reason, including product unavailability, errors in product or pricing information, suspected fraud or unauthorized activity, orders that we reasonably believe would violate applicable law if fulfilled, and orders for shipment to jurisdictions where the Products are restricted or prohibited. Order confirmation emails are acknowledgments of receipt only and do not constitute acceptance. Acceptance occurs when we ship the Products.
4. Pricing and Taxes. All prices are in U.S. dollars and are exclusive of applicable taxes and shipping charges. Sales tax will be collected on orders shipped to jurisdictions where Company has a tax collection obligation. You are responsible for any additional taxes, duties, or levies applicable in your jurisdiction.
5. Payment. We accept major credit cards (Visa, Mastercard, American Express, Discover), Apple Pay, and Google Pay. All payments are processed by our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable amount, including taxes and shipping. We do not accept PayPal, personal checks, or money orders for Website purchases.
6. Title and Risk of Loss. Title to and risk of loss for Products passes to you upon delivery of the Products to the shipping carrier at our facility (FOB Shipping Point, Buford, Georgia). Company is not responsible for loss or damage occurring during transit. We recommend that you inspect all packages upon delivery and note any visible damage with the carrier at the time of delivery.
7. Product Warranties. All Products sold through the Website are covered by the manufacturer’s limited warranty, if applicable, as described in the warranty documentation accompanying the Product. EXCEPT FOR THE EXPRESS LIMITED WARRANTY, IF ANY, ACCOMPANYING A PRODUCT, COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that Products will be compatible with any particular firearm or that the Products will meet your specific requirements. It is your responsibility to confirm compatibility before ordering.
8. Compliance with Law. You acknowledge that certain Products sold through this Website may be subject to federal, state, and local laws and regulations restricting their purchase, possession, use, or transfer. Magazines, in particular, are subject to capacity restrictions in multiple states. It is your sole responsibility to know and comply with all applicable laws. Company is not liable for any legal consequences arising from your purchase, possession, or use of Products in violation of applicable law.
9. Restocking Fee Disclosure. A restocking fee of fifteen percent (15%) applies to returned Products that have been opened but are unused and in resalable condition. No restocking fee applies to Products returned due to our shipping error or product defect. This restocking fee is disclosed to you on the Website, in these Conditions of Sale, and in our Return and Refund Policy prior to checkout in accordance with the Georgia Fair Business Practices Act, O.C.G.A. § 10-1-390 et seq., and comparable consumer protection statutes in other states. By completing your purchase, you acknowledge that this restocking fee has been clearly and conspicuously disclosed to you before the sale became final.
10. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COMPANY’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCTS GIVING RISE TO THE CLAIM. IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Governing Law. These Conditions shall be governed by and construed in accordance with the laws of the State of Georgia. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. To the extent these Conditions involve the sale of goods, the Uniform Commercial Code as adopted in Georgia shall apply.
